We have started a new blog series which we call “This Is The Law: Elder Law.” For each post or page we will give you the citation of the applicable federal law and Michigan law. In Elder Law we focus on two main areas: Medicare and Medicaid. Both are federal programs.
In Medicare what we see too often is the denial of coverage for benefits or continuation of a current benefit such as in home therapy.
Medicaid is a federal program administered by the state. Here we will give you: the federal law; the federal interpretation of Medicaid by the Medicaid division of the federal agency Center for Medicare and Medicaid services. In Michigan the program is administered by the Department of Health and Human Services. We will give you the federal law and the state administrative policies found in the Bridges Eligibility Manual (BEM).
So whenever you have a problem with agency delivery of your earned benefits you can quote “chapter and verse” of the authority you rely on. This is the law.
